Commissioner's Meeting Minutes for 12/06/04
December 6, 2004
The Ripley County Board of
Commissioners met on Monday, December 6th, 2004 in the Ripley County Annex,
Versailles, Indiana.
John Little, Commissioner President called the meeting to order promptly at
8:00AM with Commissioners Chuck Folz & Robert Reiners in attendance.
Mary Ann McCoy, Auditor of Ripley County acted as secretary for the Board of
Commissioners.
John Ertel, Attorney was present to advise the Board on legal matters due to
County Attorney Neil Comer being absent.
The Board signed the payroll check and claim register for December 6th, 2004.
Faye Wagner presented the commissioners with concerns about Ordinance #16 (for profit kennel). Tab Brinson, Area Planning & Sam Row
were present during the presentation of Mrs. Wagner.
Kelly Vollet, Technology updated the commissioners on the new gatekeeper web
site for the Probation Department. The web site will connect the schools with
the Probation Department.
Commissioner Folz made the motion to approve the Trending contract for the
Assessor’s Office with Appraisal Research seconded by Commissioner Reiners.
Motion approved unanimously.
Commissioner Reiners made the motion to approve the claims of December 6th,
2004 seconded by Commissioner Folz. Motion approved unanimously.
Commissioner Reiners made the motion to approve the minutes as corrected (that
the water line on the County right of way and bore under the county road to
Pete Jachimiak’s for son Daniel Jachimiak) seconded by Commissioner Folz.
Motion approved unanimously.
Commissioner Reiners made the motion to approve & sign the Holiday
Schedule for 2005 seconded by Commissioner
Folz. Motion approved unanimously.
Joseph Palmer & Judy Vasquez Sunman, In. presented concerns about a
drainage problem in (ditching on Negandard’s Corner) Sunman.
Commissioners will have Andy Bryant take a look at the problem.
Commissioners discussed the payroll problem at length and no solution was made
about the current problem.
Commissioner Reiners stated that at the last commissioners meeting, it was
stated that the commissioners did not want Scott Melling to work any more over
time. This was due to Melling turning in approx. 1600 to 1700 hours and
considering himself a salaried employee. Ripley county considers Melling an
exempt salaried employee, not a salaried employee. Executive employees whom we
consider Melling are paid on a salaried basis of at least $250 per week and
have as their primary duties the management of the business or department of
the business, customary & regularly the supervision of direct work of at
least two other employees. Administrative employees are paid on a salaried
basis of at least $250 a week, have as their primary duty the performance of
the office or non manual work directly related to the management policies or
general business operations. Customary
& regularly perform work involving exercised discretion &
independent judgement. Ripley
County & Margaret Mary Hospital share Melling’s salary. Reiners stated
that he had talked to Nancy Martique, Director, Margaret Mary Hospital and it
is under the hospital’s opinion that Melling is an exempt salaried employee.
The same status that Ripley
County considers him and that exempt salaried employees are not eligible for
over time pay. Reiners motioned that it is the wish of this body we tell
Melling that he is to work as many hours as needed to perform his duties as
director, seconded by Commissioner Folz. Motion approved unanimously.
The Ripley County Commissioners reviewed the annual appointment for 2005.
Commissioner Reiners made the motion to approve the appointments listed below
effective January 1st, 2005 seconded by Commissioner Folz. Motion
approved unanimously.

Commissioner Folz made a motion to
appoint Robert Reiners/Commissioner to the SIRPC for one year (2005) seconded by
Commissioner Little. Motion approved by Folz & Little.
Commissioner Folz made a motion to appoint Ted Spurlock to the Economic
Development Board (2005) seconded
by Commissioner Reiners. Motion approved unanimously.
Commissioner Folz made the motion to appoint Lawrence Nickell to the Jefferson
Proving Ground Board seconded by Commissioner Reiners.
Motion approved unanimously.
Commissioners signed as accepting agency on the Declaration of Departmental
Transfer Department of Natural Resources to Ripley County, Regarding Versailles
State Park for Bridge #8 (Cave Hill Bridge).
Commissioners signed the updated (newly revised) Contract for Emergency
Ambulance Service. (Electronic Filling of Patient care reports to the billing
company is preferred; however paper reports are acceptable if submitted through
the Ripley County EMS Director no less than weekly)
Commissioners stated that the health insurance quotes were sent to the
consultant and will be selected at the December 20th Commissioner’s meeting.
Commissioner Reiners made the
motion to adjourn until the next regular commissioner meeting on Monday,
December 20th,
2004 at the Ripley County Annex; Versailles, Indiana seconded by
Commissioner Folz. Motion approved unanimously.
