Unapproved Commissioner's Meeting Minutes for 11/07/05
November 7, 2005
The Ripley County Board of Commissioners met on Monday, November 7th, 2005 at the Ripley County Annex, Versailles, Indiana.
Commissioner Reiners promptly called the meeting to order at 8:00 AM and all stood for
the opening pledge to flag. Commissioner Reiners, Chuck Folz and Lawrence
Nickell were in attendance.
Mary Ann McCoy, Auditor took minutes for the Board of Commissioners.
Neil Comer, County Attorney was present to advise the Board on legal matters.
Becky Mullin, Maintenance presented concerns to the commissioners about her comp time and not being able to use it. Mullin advised the commissioners that she would be working two (2) hours in the morning for Mr. Bishop and instead of coming in the evening at 3:00 PM she would come in at 5:00 PM and work till 10:00PM. Commissioners thanked her for working with the situation at the present time.
John Gause, Apex thanked the commissioners for their business in 2005.
Kelly Vollet, Technology advised the commissioners that she had found a shredder for the storage building for $1,352.03 (Fellows Power 420 CC Shredder). Commissioner Nickell made a motion to purchase the shredder and seconded by Commissioner Folz. Motion approved unanimously.
Tad Brinson, Planning Commission presented Ordinances to the Commissioners for their consideration. Folz made a motion to approve the Ordinance to Amend the Area Zoning Code of Ripley County, Indiana, 1991, as Amended, By Amending Section 80.43 (163) Zone Map Definition and Repealing Section 80.09 (A) (8) Farmstead Lot of the Area Zone Code OF Ripley County, Indiana seconded by Commissioner Nickell. Motion approved unanimously.
Commissioner Nickell made a motion to approve the Ordinance to Amend the Area Subdivision Control Code of Ripley County, Indiana 1991, (Section 1: Section 81.04, Figure 1, Step 1 is amended to add Section 81.04, Figure 1, Step 1 (B)(27) and Section 2: Section 81.061/2 (B) (6) is amended & Section 3: Passage seconded by Commissioner Folz. Motion approved unanimously.
Commissioner Folz made a motion to approve the Ordinance to Amend the Area Zoning Code of Ripley County, Indiana 1991, As Amended (Section 1, Replacement of The Existing Zone Map, Section 2. Background, Rationale, And Policy, Section 3. New Zone Map or Area Zone of 2005, Section 4. New Definition of Zone Map, Section 5. Severability, Section 6. Passage) seconded by Commissioner Nickell. Motion approved unanimously.
Commissioners had concerns about the hearing officer for the Unsafe Building Code and asked that Brinson contact Attorney Ertel to see if he had anyone in mind from Ripley County to fill this position.
Commissioner Folz made a motion to approve the minutes from the Oct. 24th, 2005 meeting as corrected seconded by Commissioner Nickell. Motion approved unanimously.
Mary McCarty, SIRPC presented a Release of Mortgage to the Ripley Commissioners for George W. Kissell & Martha J. Kissell. Commissioner Nickell made a motion to do Release of Mortgage for the Kissell’s seconded Folz. Motion approved unanimously.
Commissioner Folz made a motion to sign the Two (2) Release of Liens on Johnson, Kielbasa & Meyer seconded by Commissioner Nickell. Motion approved unanimously.
Commissioner Folz corrected his motion to sign the Release of Liens from two (2) Liens to three (3) Liens.
Ray Hartman, Asphalt Materials advised the commissioners that nothing had changed from the 2005 liquid asphalt contract to the 2006 contract and advised that there would not be a surcharge. (Rolled bid at the Oct. 7th, 2005 Commissioner’s meeting)
Dennis Cooper, Berry Materials had questions on the surcharge and wondered if it was in the best interest of the tax payers of Ripley County to roll the bid.
Commissioner Reiners advised those present that the commissioners had rolled the bid and that the contract is the same as it was in 2005. (No surcharge and price adjustment-Escalation and De-Escalation Clause).
Jeff French, Surveyor & Tad Brinson, Area Planning Commission had concerns about county roads standards. Commissioner Reiners advised that they are not satisfied with the way roads are handled at the present time and would like to have a road done at least a year before the county takes it over. Highway & Commissioners will work to put something together.
Commissioners opened the Bids for Bridge #100 Mollenkamper Reservoir County Road 300E promptly at 10:00AM.

Commissioner Reiners advised that the Neil Comer, County Attorney & John F. Graf, Engineer will look at the bids and return with the decision at the November 21st, 2005 commissioner meeting. Graf advised that the Engineer’s bid is $252,000.
Commissioners opened the Health Insurance Bids for the year of 2006 promptly at 10:00 AM.

Neil Comer, County Attorney reported that Mr. McCormick will try to return with a decision at 10:00AM on the 21st of November, 2005.
Attorney Comer advised that the Judge has ruled on Bridge # 8 and the deed should be on Schuerman’s desk.
Commissioner Nickell made a motion to accept the change order#1 presented by John Graf, for Poole Group of an increase of $3,166 (Courthouse Repairs) seconded by Commissioner Folz. Motion approved unanimously.
Jerry Vollmer, Main Source Insurance updated the commissioners on the general liability coverage for the Ripley County 4 H Fairgrounds. Vollmer presented an estimated annual premium of $900. Attorney Comer advised that this is the 4H insurance policy and should be picked up by the 4H.
Tammy Cromer presented the commissioners with concerns about the erecting of a privacy fence. Attorney Comer advised that the commissioners do not deal with this problem and that she should contact her attorney.
Pat Thomas, Health Department asked the commissioners for permission to use the courthouse hall to promote Smoke out Week/Thursday, November 16th, 2005. Commissioners gave their permission.
Commissioner Folz made a motion to sign an Ordinance for the Ripley County Recorder, Tammy Borgman to establish a new fund for the Ripley County Identification Security Protection Fund as of January 1st, 2006 seconded by commissioner Nickell. Motion approved unanimously. Borgman also asked the commissioners about the personal days and had they made a decision. Commissioner Reiners advised that they are still working on the personal days and would get back to them at a later date.
Mary Ann McCoy, Ripley County Auditor advised the commissioners that due to a holiday on January 1st, 2006 commissioners should probably met on December 30th, 2005 to do payroll and finish the year end. Commissioner Nickell made a motion to meet on December 30th, 2005 seconded by Commissioner Folz. Motion approved unanimously.
Commissioner Reiners signed the Steinhardt Heating & Air Conditioning bill for boiler.
Commissioner Nickell made a motion to adjourn until the next regular meeting on Monday, November 21st, 2005 @ 8:00AM at the Ripley County Annex, Indiana seconded by Commissioner Folz. Motion approved unanimously.
