Unapproved Commissioner's Meeting Minutes for 03/26/07
March 26, 2007
The Ripley County Commissioners met on Monday, March 26th, 2007 at the Ripley County Annex, Versailles, Indiana.
Commissioner Reiners promptly called the meeting to order at 8:00A.M. All stood for the opening pledge to the flag.
Robert Reiners, Chuck Folz were in attendance and Lawrence Nickell was not present.
Mary Ann McCoy, Ripley County Auditor took minutes for the commissioners.
Neil Comer, County Attorney was present to advise the commissioners on legal matters.
Commissioner Folz made a motion to approve the minutes from the March 12th, 2007 commissioner meeting seconded by Commissioner Reiners. Motion approved by those present. Nickell was not present.
John Lohrum, Maintenance advised the commissioners that Judge Morris would like to have some ceiling fans for his courtroom and office. Commissioners approve this project for Judge Morris.
Gilbert Lester Wilson, New Marion Indiana advised the commissioners he would like to close 1st North Street in New Marion. Wilson is the property owner on both sides of the abandon street. Attorney Comer will need to advise on this procedure.
Ernie Brison & Son presented concerns to the commissioners over a summons that they had received concerning cleaning up of their property due to old cars and racecars. Tad Brinson & Steve Myers advised the commissioners that the summons was sent to make sure that everything is cleaned up and then it will be dismissed after it is checked by Brinson and Myers. Area Planning Commission will make the decision on summon after it is checked by Brinson & Myers.
Kelly Vollet, Technology advised the commissioners that she had nothing to present.
Kathy Eaton, INDOT /Program Budget Manager Seymour District, Robert E. Williams, District Deputy Commissioner Seymour District, Brandy Fischvogt, Owen Heaton, Ripley County Highway Superintendent & Ray Toops, District 3 Foreman were present to discuss the project listing for Ripley County. Eaton advises the commissioners and those present that it is now mandated by the Federal Government to review all local projects. Two of the projects under review were Bridge#89 and Bridge# 38 by INDOT. Owen Heaton, Highway Superintendent advises Eaton that Ripley County had scrapped the Bridge#89/ over Ripley Creek on Old Milan Road project. Eaton advised that there will be no funding for the Bridge#38 Old Michigan Road project at the present time and if the county proceeded with this project the county will pay 100% of the project. Eaton advised the commissioners that the earliest any federal funding would be available is in 2014 and asked that the commissioners send a letter to INDOT as to the status of bridge#89 & bridge 38 projects. Commissioner Reiners asked that Eaton come back to the next meeting April 9th, 2007 to update Commissioner Nickell due to his absence at today’s meeting.
Shawna Bushhorn, Assessor advised the commissioners that she would like to change her software companies from Appraisal Research Services to Assessment Software Solutions Inc. for Sales Disclosures, Personal Property & Mobile Homes database and management system. Commissioner Folz made a motion to go with AS2 for the Assessor’s database and management of Personal Property, Mobile Homes and Sales Disclosures seconded by Commissioner Reiners. Motion approved by those present. (Reiners and Folz) Nickell was not present at this meeting.
Commissioner Reiners gave a short tribute to Darren Baker who had passed away. Reiners advised that the Baker will be sadly missed by Ripley County due to the work and involvement he made to Ripley County.
Gilbert Wilson had presented concerns to the Commissioners about the closing of a road in New Marion, Indiana. Attorney Comer advised that to close a road in the county you would need to file a petition and have a public hearing for any interested parties before the road can be closed. Commissioner Reiners advised Mr. Wilson that the legal process would have to be followed to close the road.
Commissioner Folz made a motion to sign the Notice to Proceed for the replacement of Ripley County Bridge #8 on Cave Hill Road across Branch of Laughery Creek and Westbound passing lane and construction of gabion retaining wall along US 50 where Cave Hill Road meets US 50 seconded by Commissioner Reiners. Motion approved unanimously. (Reiners and Folz)
Andy Bryant, Ripley County Health Department presented a letter to the commissioners that had been sent to the Horse and Buggy Auction House concerning the waste disposal system for the Cross Plains Auction House (Horse and Buddy Auction House). Per Ripley County Ordinance and Indiana State Department of Health code, sewage is all water carried waste derived from ordinary living process. All sewage must run into a public sewer or legal waste disposal system. Bryant presented a letter to the commissioners that had been sent to Troy Mathis concerning the failed septic system for Horse and Buggy Auction House located at 9997 S. SR 129 Cross Plains and that the Auction House must stop using the indoor bathroom and stop using the kitchen, or totally shut down the Auction House. Bryant advised in the letter that to the best of his knowledge Mr. Mathis has not contacted the Indiana State Department of Heath per their conversation on 1/8/07.
Commissioner Folz made a motion to amend the Ripley County Economic Development Income Tax Capital Improvement Plan for 2007-2008 seconded by Commissioner Reiners. Motion approved unanimously. (Reiners and Folz)
Commissioner Folz made a motion to adjourn until the next regular meeting on Monday, April 9th, 2007 @ 8:00A.M. at the Ripley County Annex, Versailles, Indiana seconded by Commissioner Reiners. Motion approved unanimously. (Reiners and Folz)
