Unapproved Commissioner's Meeting Minutes for 03/13/06

March 13, 2006

The Ripley County Commissioners met on Monday, March 13th, 2006 at the Ripley County Annex, Versailles, Indiana.

Commissioner Reiners promptly call the meeting to order at 8:00A.M. and all stood for the opening pledge to the flag. Commissioner Reiners, Chuck Folz and Lawrence Nickell were in attendance.

Mary Ann McCoy, Ripley County Auditor took minutes for the Commissioners.

Neil Comer, County Attorney was present to advise the Board on legal matters.

Commissioner Folz made a motion to approve the purchase of 12 chairs @ $385 each for the commissioner’s room from the Cum Cap fund seconded by Commissioner Nickell. Motion approved unanimously.

Commissioner Nickell made a motion to approve the minutes from the February 27th, 2006 meeting seconded by Commissioner Folz. Motion approved unanimously.

Commissioner Nickell made a motion to give a master key and basement key for the courthouse to the Versailles Fire Department for the Chief & Assistant Chief seconded by Commissioner Folz. Motion approved unanimously.

Sheriff Davison advised the commissioners that he has four (4) vehicles for sale (3cars & 1 SUV). Sheriff Davison advised that they had received a bill for $908 from EMS. Commissioner Reiners will check on this for the Sheriff.

Kelly Vollet, Technology Director had concerns about putting voting precinct & polling places (due to addresses) on the Internet with WTH. Commissioner Nickell made a motion to approve Technology Director, Kelly Vollet putting the Voting Precinct and Polling Places on the Internet seconded by Commissioner Folz. Motion approved unanimously.

Tad Brinson, Area Planning Commission presented Ordinances for the Commissioners consideration. Commissioner Folz made a motion to approve the Ordinance# (2006-06) the Unified Zoning Ordinance of Ripley County for Part of the S.E. ¼ of Section 32, Township 10 North, Range 13 East /Adams Twp. 3.256 Acres for Larry Decker from existing A-2 to R-B seconded by Commissioner Nickell. Motion approved unanimously.

Commissioner Nickell made a motion to approve Ordinance # (2006-07) To Amend the Area Zoning Code of Ripley County, Indiana 1991, As Amended by the Board of Commissioners of Ripley County, Indiana, And by the Town Counsel of Napoleon, or Osgood, or Milan, or Holton or Sunman or Versailles, Indiana, Under the Authority of the Indiana Area Planning Law (I.C. 36-7-4 ET. SEQ.) And all Acts Amendatory or Supplemental, Thereto General Assembly of the State of Indiana, Section 1: Section 81.04, Figure 1, Step 1 is amended to add Section 81.04, Figure 1, Step 1 (B) (28), Section 2: Section 81.04, Figure 1, Step 1 is amended to add Section 81.04, Figure 1, Step 1 (B) (29), Section 3: Section 81.06 ½ (B) (6) & Section 4: Passage seconded by Commissioner Folz. Motion approved unanimously.

Commissioner Nickell made a motion to approve the Ordinance# (2006-08) to Amend the Area Zoning Code of Ripley County, Indiana, 1991. As Amended, By Adding Section 81.03 (27) (e) (7) “Exempted Subdivision Definition and Adding Section 81.03(32) “Parent Parcel” Definition and Section81.03 (33) “Existing Tract” Definition of the Area Subdivision Control Code of Ripley County, Indiana seconded by Commissioner Folz. Motion approved unanimously.

Steve Meyer, Building Inspector advised the commissioners that he had questions on a red tagged building with no building permit. Meyer questioned the enforcement of this order. Attorney Comer will check on this matter and see whose jurisdiction this comes under.

Mark Keillor appeared in front of the commissioners concerning Lawrenceburg Gaming Grant. Keillor advised the commissioners to call him, if they need any help with Lawrenceburg Gaming Grant.

Commissioner Folz made a motion to approve the polling place change of Adams 2 to the New American Legion Post, Sunman, In. for the next 5 years seconded by Commissioner Nickell. Motion approved unanimously. Roger Lang had requested that it be at least a 5 year period.

Bradford requested that the commissioners pay for Spanish lessons for her & some of her deputies. Commissioner Folz made a motion to approve sending (3) three from the Clerk’s Office for Spanish lessons, with the cost of $164 per person @ Ivy Tech/24 hour class seconded by Commissioner Nickell. Motion approved unanimously. 

Commissioner Folz made a motion to approve the designated polling places for the Ripley County 2006 Election seconded by Commissioner Nickell. Motion approved unanimously.

  Kenny Tapp, Meteorology, School of Meteorologist, University of Oklahoma   presented a slide presentation to commissioners on the 911 Safety program measuring & predicting depth hazards for Ripley County, associated with heavy rainfall in the Laughery Valley Watershed and other at-risk areas of the county.  Tapp advised the commissioners that he would be able to give maps showing what roads would flood following a heavy rain fall. Tapp requested to obtain a copy of the “safety layer” GIS data that represents the approximate locations and addresses of known occupied residential structures of the county. This information would greatly assist in identifying locations of the greatest flood risk. The results from the research would be given to interested parties of Ripley County in late May, 2006.Tapp advised the commissioners that he needs to know if he can get this information by the 1st of April, 2006. Commissioners will take this under consideration and get back to Mr. Tapp by the next meeting on the 27th of March.

Commissioners opened bids for the New Diesel Dump Truck promptly at 10:00AM. The following bids were received by the commissioners:

Commissioner Reiners advised that Neil Comer, County Attorney will look at the bids and decision will be made at the next meeting March, 27th, 2006.

Larry Volz presented concerns about the black topping of Delaware camp ground road/150East. Commissioner Folz advised that this is in the plans to be done in 2006.

Volz advised the commissioners that it is now 3 years later and nothing has been done on the existing problem at 225 & 450N and that a complaint had been filed with the planning commission concerning this problem. Commissioners will bring this complaint up with Tad Brinson, Area Planning Commission.

Kevin Hensley, Town of Versailles Street Department is requesting that the Economic Development Park be blacktopped and thought that this would be a good choice for the use of the Lawrenceburg Grant, from the Riverboat funds. Hensley also requested chip and seal of Benham Road. Commissioners will take this under consideration. Hensley advised that the town is willing to pay for this service.

John Graf, Barth & Associates advised the commissioners that the guardrail for bridge#100 was not approved on the present program. Commissioner Nickell made a motion to proceed with Bridge #100 over Mollenkramer Reservoir, with Jeff Meiners/ C & H/M Excavating, Inc. seconded by Commissioner Folz. Motion approved unanimously. Commissioner Reiners signed the Notice to Proceed for Bridge #100 and Graff presented C & H/M‘s Performance Bond for the replacement of Bridge # 100 over Mollenkramer Reservoir.

Graf advised the commissioners that he has received the Des# (go ahead with preliminary engineering) for Bridge # 38 and that the Federal grant for construction was turned down and he will  re-apply again this fall for Ripley County. Commissioner Nickell advised that he had nothing on the Cave Hill Bridge project.

Commissioner Nickell made a motion to approve Low’s Technical Service/Support for 2006 at $20,400 for the Auditor and Treasurer’s Office seconded by Commissioner Folz. Motion approved unanimously.

Commissioner Reiners signed the invoice for Ripley County’s Portion of consulting fee ($875) for John M. House dba House Properties, LLC with Jefferson County & Crawford County.

Commissioner Nickell made a motion to adjourn until the next regular meeting on Monday, March 27th, 2006 @ 8:00 AM at the Ripley County Annex, Versailles, Indiana seconded by Commissioner Folz. Motion approved unanimously.
