Unapproved Commissioner's Meeting Minutes for 03/12/07

March 12, 2007

The Ripley County Commissioners met on Monday, March 12th, 2007 at the Ripley County Annex, Versailles, Indiana.

 

Commissioner Reiners promptly called the meeting to order at 8:00A.M. All stood for the opening pledge to the flag.

 

Robert Reiners, Chuck Folz and Lawrence Nickell were in attendance.

 

Mary Ann McCoy, Ripley County Auditor took minutes for the commissioners.

 

Neil Comer, County Attorney was present to advise the commissioners on legal matters.

 

Jeff Volz, Osgood Town Board advised the commissioners that he would like to be on the new water board when it is established. Commissioners will take this under consideration.

 

John Lohrum, Maintenance advised the commissioners that he had looked at a new zero turn mower for the courthouse. Lohrum advised that his old mower needed maintenance each time that it is used. Commissioner Nickell made a motion to approve Lohrum purchasing a new zero turn mower for the courthouse seconded by Commissioner Folz. Motion approved unanimously.

 

Tad Brinson, Area Planning Commission presented rezoning ordinances for the commissioners’ consideration. Commissioner Nickell made a motion to adopt the Ordinance to Amend the Unified Zoning Ordinance Of Ripley County, Indiana for the Wade Property/ Part of the S.W. ¼ of Section 14, Township 7 North, Range 11 East. Johnson Twp. 6.5 Acres more or less from existing A-2 Agricultural to G-B General Business, Wade Property/ Part of the S.W. ¼ of Section 14, Township 7 North, Range 11 East. Johnson Twp. 61 Acres  more or less from A-2 Agricultural to I-1 Enclosed Ind., Curry Property/ Part of the S.W. ¼ of Section 14, Township 7 North, Range 11 East. Johnson Twp. 2.5 Acres more or less from I-1 Enclosed Industrial to G-B General Business and the Halcomb Family Limited Partnership Property/ Part of the East Half of Section 14, Township 7 North, Range 11 East. Johnson Twp. 9.145 Acres from A-2 Agricultural to I-1 Enclosed Industrial seconded by Commissioner Folz. Motion approved unanimously.

 

Commissioner Nickell made a motion to approve the Ordinance To Amend The Area Zoning Code Of Ripley County, Indiana, 1991, As Amended, By Amending Section 80 Figure 1 As To The Minimum Setbacks In The I-1 And I-2 Districts Where Said Zones Adjoin The A-1, A-2, Fr, R-1, R-2, Or R-3 Districts Or Where I-1 And I-2 Districts Adjoin A Residential Use  Of The Area Zone Code Of Ripley County, Indiana, seconded by Commissioner Folz. Motion approved unanimously.

 

Commissioner Nickell made a motion to approve the Ordinance To Amend Section 80.37 Of The Area Zoning Code Of Ripley County, Indiana, 1991, As Amended, By Amending Section 80.37 (C) (3) And (4) Regarding Zones and Setbacks For Advertising Sign Or Billboards In Various Districts Of The Area Zone Code Of Ripley County, Indiana seconded by Commissioner Folz. Motion approved unanimously.

Commissioner Folz made a motion to approve the minutes from the February 26, 2007 meeting seconded by Commissioner Nickell. Motion approved unanimously.

 

Tom Grills, Ripley County Sheriff advised the commissioners that the showers at the jail are in need of repair. Commissioner Nickell made a motion to approve the repair of showers at the jail at an approx. cost of $18,000 with G.B. Carpets from the Cum Cap Fund seconded by Commissioner Folz. Motion approved unanimously.

 

Mary McCarty, Southeastern Regional Planning Commission updated the Commissioner on the Grant for the New Marion Fire Department and the Public Hearing for the Ripley County/New Marion Volunteer Fire Department Fire Station Project was held in the Ripley County Commissioners Room, Ripley County Annex at 9:00AM.

Commissioner President Reiners signed then Resolution Authorizing Application Submission And Local Match Commitment, Citizen Participation Report, Certification, Readiness To Proceed Certification, Status of Required Environmental Review Process, Status of Site Control,  Status of Permits, Indiana Office Of Community And Rural Affairs Community Development Block Grant Small Cities Program Assurances and Certifications, CDBG Disclosure Report, Certification of Expected Sources and Uses Of Funds and Civil Rights Certification for the Ripley County/ New Marion Volunteer Fire Department Fire Station Project Grant.

 

Quality Plumbing & Heating presented service recommendations that had been recorded by their technicians and the annual 2007-2008 HVAC Preventive Maintenance Contract.

Commissioner Nickell made a motion to approve the 2007-2008 HVAC Preventive Maintenance Contract with a monthly cost of $695 making a total cost of $8,340 per year seconded by Commissioner Folz. Motion approved unanimously.

 

Cary Langden, Engel Maps was here checking on the grant application for the book maps and where we were at the present time. Commissioner Reiners advised that the board will meet on March 28th to make a decision on the grant application for the book maps.

 

Kelly Vollet, Technology Director presented the Service Agreement with Certified I.T.,LLC and Ripley County allowing information concerning property taxes owed to Ripley County to be accessed via the Internet and to allow the property taxes owed to Ripley County  be paid via the Internet. Commissioner Nickell made a motion to approve the Service Agreement with Certified I.T., LLC effective today’s date seconded by Commissioner Folz. Motion approved unanimously. Vollet updated the commissioners on the phone line project for the Sheriff Office.

 

Jeff French, Ripley County Surveyor advised the Commissioners that there seemed to be some confusion concerning who is to take care of the maps for the county. French advised that the Auditor and the Surveyor entered into a contract with the Surveyor to do the maps instead of the Auditor’s Office several years ago.

 

John Gause, Anthem Insurance presented the year end financials from Anthem Insurance (Health) for 2006 and presented documentation that illustrated the results of 2006 and the current balance for 2007. Protected Deposit Account is $50,724.42, $16,614.83 of which will be required to fund the shortfall from the 2006 plan year. Gause advised that this leaves a balance of $34,109.59 in the Protected Deposit Account for 2007.

 

 

 Commissioner Folz made a motion approving that President Reiners sign the letter of authorization to use funds for the shortfall for 2006 seconded by Commissioner Nickell. Motion approved unanimously. Commissioner President Reiners signed the letter of authorization to use $16,614.83 from the Protected Deposit Account to fund the shortfall experienced during the 2006 plan year. Commissioner President Reiners signed the Refund Agreement, Schedule of Financial Variables for the Refund Agreement, Schedule of Financial Variables for the Refund Agreement between Ripley County Government and Anthem Insurance Companies, Schedule of Financial Variables for Ripley County Government and Schedule of Financial Variables for the Refund Agreement between Ripley County Government and Anthem Insurance Companies.

 

Attorney Comer updated the Commissioners on the water project with Decatur, Jennings and Ripley County (three county districts). Comer advised that he is in the process of preparing the documents for the counties to sign and that he would recommend that Ripley County participate in the water project at a cost of $5,000 which includes attorney fees,  with Decatur and Jennings County.

 

John Graf, AECON updated the commissioners on the Bridge #8 project and that they were to start today but did not received the Notice to proceed. Graf also updated the commissioners on the Bridge#38 project and advised that the state had refused to Review.

 

John Lohrum, Maintenance advised the Commissioners that the new 42 in cut/ zero turn mower will cost approximately $2199. 

 

Commissioner Folz made a motion to adjourn until the next regular meeting on Monday, March 26th, 2007 @ 8:00A.M. at the Ripley County Annex, Versailles, Indiana seconded by Commissioner Nickell.
